We are pleased to offer the use of Polaris off-road vehicles as a courtesy for your enjoyment while visiting Midnight Canyon Ranch. Please note that these vehicles are not registered for street use and must remain within the designated ranch boundaries. The terrain and nature of these vehicles present potential risks, and we require all guests to acknowledge and accept these risks before use.
- Acknowledgment of Risks
I, the undersigned, understand and acknowledge that operating or riding as a passenger in a Polaris off-road vehicle involves inherent risks, including but not limited to the risk of personal injury, damage to property, or even death. I accept that these risks may be caused by the vehicle’s design, the ranch terrain, weather conditions, or my own actions and decisions.
- Assumption of Responsibility
I voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, which may arise from my use or participation in operating a Polaris vehicle at Midnight Canyon Ranch. I also accept full responsibility for any minors or dependents under my care who may be participating with me.
- Acknowledgment of Boundaries
I understand that Polaris vehicles provided by Midnight Canyon Ranch are not registered for street use and must remain strictly within ranch boundaries. I agree not to drive or operate these vehicles outside the designated areas.
- Waiver of Liability
In consideration of being permitted to use a Polaris vehicle, I hereby waive, release, and discharge Midnight Canyon Ranch, its owners, employees, affiliates, and any associated parties from any and all claims, liabilities, or causes of action arising out of any injury, damage, or loss resulting from my participation in Polaris vehicle use, whether caused by negligence or otherwise.
- Agreement to Follow Rules
I agree to follow all provided rules, guidelines, and safety instructions for operating the Polaris vehicle. I understand that failure to comply may result in revocation of vehicle privileges.
6. Emergency Medical Assistance
In the event of an accident or injury, I authorize Midnight Canyon Ranch personnel to arrange medical assistance as deemed necessary. I understand that I am financially responsible for any medical services rendered.
